A 26-year-old man has been remanded in custody after he was charged with assaulting a homeless man whose body was found dumped in a refuse chute in Cork earlier this month.
David O'Loughlin was charged with assault causing harm to long term Simon Community resident, Liam Manley (59) at City Gate Apartments, North Main St, Cork on May 12th.
Mr Manley’s body was found in a refuse chute at City Gate Aparments on May 13th by a maintenance man when he went to clear rubbish which had built up in the chute.
Today at Cork District Court, Det Garda Katrine Tansley told how she arrested Mr O’Loughlin at the Bridewell Garda Station at 10.55pm on May 22nd.
She gave evidence of arrest, charge and caution and told the court that Mr O’Loughlin made no reply to the sole charge of assault causing harm when it was put to him after caution.
Insp Mick McGuire said gardaí were seeking a week-long remand in custody to obtain the DPP’s directions in relation to Mr O’Loughlin.
Defence solicitor, Frank Buttimer said that his client was not seeking bail at the moment and he was consenting to the garda application for a remand in custody.
Mr Buttimer said Mr O’Loughlin, whose address was given at No 10 City Gate Apartments, North Main Street, Cork was currently not working and was applying for legal aid.
Judge Leo Malone granted Mr O’Loughlin free legal aid and remanded him in custody for a week to appear again at Cork District Court on May 30th by video link.
