Settlement over alleged mismanagement of birth made without admission of liability

A boy alleged to have suffered injuries as a result of alleged mismanagement of his birth at Kerry General Hospital has settled his action against the HSE on terms including an interim payment of €1.75 million.

The settlement was made without admission of liability. The High Court will decide in six years' time on the costs of the future care needs of Jeremiah Daly of Clogher Drive, Lixnaw, Co Kerry.

Through his mother Edwina Daly, the 12-year-old sued the HSE over the management of his birth at Kerry General Hospital between March 22nd and March 24th, 2003.

Approving the settlement, Mr Justice Kevin Cross congratulated Jeremiah's mother for her work caring for her son and said he hoped the settlement would give the boy the life he could have and was entitled to.
