Mother (80) liable for judgment on €1m guarantee for loan to son

The 80-year-old mother of a fuel distributor whose business went into receivership is liable for judgment over a €1 million guarantee she provided for a loan to her son, the Commercial Court has ruled.

Maureen Curran, Oldcastle, Co Meath, had not established an arguable defence to Bank of Ireland's claim in relation to the guarantee and the bank was therefore entitled to judgment against her for the €1 million, Mr Justice Brian McGovern said.

Ms Curran, a widow, is the mother of Michael Curran, whose XL Fuels Group, Oldcastle, went into receivership when the firm defaulted on loans from Bank of Ireland.

On November 9th last, judgment for €2.2 million was entered against Mr Curran himself, who did not defend the application.

Receiver Kieran Wallace took injunction proceedings seeking, among other things, the handover of files and documents.

Mr Curran later co-operated with the receiver.

Separately, the bank brought proceedings seeking judgment against both Mr Curran and his mother.
