Colman O'Donnchadha, for House of Colemore Ltd, told Judge David Riordan that the matter could be struck out with the consent of all the parties.

House of Coolmore Ltd had alleged that the kitchen was supplied in September 2006 at a cost of €76,166 and that €35,238 was paid to the company by the O’Garas.

The plaintiff had claimed that they subsequently paid a photographer to take promotional photographs of both defendants in the supplied kitchen and that the defendants later refused to approve the promotional photographs for publication, or to pay the sums due.
