A three-and-a-half-year-old boy who fractured his right foot in a Dublin creche was on Tuesday awarded more than €12,000 in the Circuit Civil Court.
Barrister Siobhan Gaffney told the court that Aaron Bohan was attending the Carefree Days Creche and Montessori at Knockmaree, St Laurence's Road, Chapelizod, when he fell down a slide in June of last year.
Ms Gaffney told Judge John Hannan that Aaron's mother, Maura Bohan, was not informed of the incident by the creche staff when she collected her son.
Ms Bohan noticed Aaron was limping and the next day he attended the Accident and Emergency Department of Children's University Hospital, Temple Street in Dublin, where X-rays revealed a fracture to his foot.
Aaron sued the creche through his mother, Ms Bohan, of Kings Hall, Chapelizod.
Judge Hannan heard the creche had made a €12,550 settlement offer, which Ms Gaffney recommended to the court.
The judge, hearing that Aaron had made a full recovery and will not need any further treatment, accepted the offer.
