Another of five males accused of having sexual intercourse with a 15-year-old girl at a house party has elected for a Circuit Court trial.
Tallaght Court was told it will be alleged that as the girl was in her bedroom with the teenager, she heard a male voice say outside “get in line”.
The 18-year-old, with an address in Rathfarnham, is charged with having sexual intercourse with a named female child under the age of 17 at an address in Rathfarnham on March 14th, 2014, contrary to Section 3 (1) of the Criminal Law (Sexual Offences) Act, 2006.
He was before Judge Dermot Dempsey for disclosure and for his election for his case to be kept in the District Court or dealt with in the Circuit Court.
The court had heard it will be alleged that on March 14th, 2014, the injured party, who was 15, left her home at 7pm and a bottle of vodka was purchased for her in a local Lidl. The girl drank the bottle and friends brought her home at 8.30pm as she was drunk.
It will be alleged that an impromptu house party occurred at the house and that five males had sexual intercourse with her.
She alleged that she was scared and could not “physically say no”, the court had heard.
The 17-year-old has elected for a Circuit Court trial.
The first 16-year-old has pleaded not guilty, the second and third 16-year-olds still have to make their election.
The 18-year-old was accompanied by his parents. His lawyer, Michael Hennessy told Judge Dempsey that it was "a case with extensive disclosure".
He told Judge Dempsey that a book of evidence would be required in the case and said a co-accused was due before the court on April 1st for service of his book of evidence.
Judge Dempsey remanded the 18-year-old for service of the book.
