A MAN who failed in an attempt to sue a midwife for interrupting a video of the birth of his daughter has no regrets about bringing the matter to the courts as he feels he was “wronged”.
John McAuley, Beatty Park, Celbridge, Co Kildare, said bringing the issue to the courts “was the last thing we wanted” to do, but that he would do it again if a similar incident occurred.
“If I felt I was wronged and the only redress was the legal one then I would go down that road again if I was given no choice like I was in this situation,” he said.
Mr McAuley brought the claim against midwife Iris Halbach and Mount Carmel Hospital in Dublin because he was interrupted as he filmed the labour of his partner Jurgita Jachimaviciute during the delivery of their first child in the hospital in December 2006.
On Tuesday Judge Joseph Mathews threw out Mr McAuley’s €38,000 breach of contract claim when he heard the midwife had asked for a short stop in filming while she carried out emergency clearance of the baby’s airways.
